Welcome to The Joint Commission's WikiHealthCare web site. This Registration & User Agreement (referred to henceforth as the "Agreement") applies to the WikiHealthCare web site and associated web pages and applications (referred to henceforth as "WikiHealthCare" or the "Site") operated by
The Joint Commission. By using this site you signify your acceptance to these terms. If you do not agree to these terms, do not use the site. Acceptance of the terms and conditions (the "terms") detailed below represents an agreement between The Joint Commission and you ("you" and "your" for purposes of this agreement apply to and include the individual registering as well as any organization for which the individual is acting as employee, agent or otherwise and on behalf of which the individual is agreeing to these terms). Please note that certain features available through WikiHealthCare may also have additional terms posted that apply specifically to those features in addition to this Agreement or, if expressly so stated, instead of this Agreement.
PLEASE READ THIS LEGAL AGREEMENT CAREFULLY BEFORE USING THE SITE. THE FOLLOWING TERMS GOVERN ACCESS TO AND THE USE OF THE
WIKIHEALTHCARE SITE AND ANY PROGRAMS, SERVICES, PRODUCTS, TRANSACTIONAL FEATURES, BULLETIN BOARDS, CHAT ROOMS, FUNCTIONALITY, AND INFORMATION AVAILABLE THROUGH THE SITE OR USED IN CONNECTION THEREWITH.
YOU WILL BE LEGALLY BOUND TO THESE TERMS BY THE FIRST TO OCCUR OF CLICKING "I ACCEPT" AT THE END, OR BY OTHERWISE ACCESSING OR USING ANY PART OF THE SITE. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU CANNOT ACCESS OR USE THE SITE.
1. Use Rights. If you accept the terms and conditions of this Agreement, you may access and use the site.
2. User Accounts. You must register to use the site. Required registration fields (your name, e-mail address, organization, etc.) must be accurate at the time of registration. Failure to provide accurate registration information will result in the disabling or termination of your user account. Once an account has been deactivated, the username associated with that account may be given to another user without notice to you or any other party.
3. Privacy Rights. Registration requires you to disclose some personal information, such as your name, title, and affiliated institution. As a condition of use, you agree that this information will be made available to all registered users of the site. Personal information collected by The Joint Commission as part of the Registration process may be stored and processed in the United States or any other country in which The Joint Commission or its agents maintain facilities. By using the site, you consent to any such transfer of information outside of your country and to the uses of information set forth above and in the WikiHealthCare
Privacy Policy. Please review the WikiHealthCare Privacy Policy in its entirety. As a condition to using the site, you agree to the terms of the WikiHealthCare Privacy Policy as it may be updated from time to time. You agree that The Joint Commission may collect, hold, and use, directly or through its affiliates, contractors, successors, assigns, and agents, the personal information you submit through the site as set forth in the WikiHealthCare Privacy Policy. You agree that The Joint Commission may (but is not obligated to) monitor, edit, or disclose your personal information, if required to do so in order to comply with any valid legal process or governmental request (such as a search warrant, subpoena, statute, or court order), or as otherwise provided in these Terms and the WikiHealthCare Privacy Policy. All data collected by or on behalf of The Joint Commission relating any use of the site or its content by any users is and shall remain at all times the sole property of The Joint Commission.
4. Scope of Agreement. Your registration applies to you and may not be sold or transferred in any other manner. This site is protected by copyright and other intellectual property laws or treaties. This Agreement only gives you the right to use this site. The Joint Commission reserves all other rights.
5. User Responsibilities. In consideration of being allowed to use WikiHealthCare, you agree to the following:
- To read all policies and disclaimers. The policy provisions and disclaimer notices are hereby incorporated into this Agreement. These policies and disclaimers may change from time to time and you assume responsibility for keeping up to date with the current version of the policies and disclaimers and this Agreement.
- To be nice and play fair. You agree not to post any content with is offensive, obscene, unlawful in any way, infringes on the rights of others, is defamatory, threatening, harrassing, or abusive in any manner.
- To follow the law. WikiHealthCare is not to be used for any purpose in violation of local, state, national or international laws. You agree to post information which does not infringe on others intellectual property rights, privacy rights or publicity rights.
- To represent yourself and/or your organization and not impersonate another person. You will not share your password with others, or allow another person to use your identity for posting or viewing content.
- To respect WikiHealthCare and the other authorized users of this site. You agree to participate in a manner designed to protect the the environment created for the sharing of ideas among colleagues, which includes doing nothing harmful to the site, not distributing a virus, or harmful computer code, or participating in "spamming".
- To warrant that you have the rights to post any material that you supply to WikiHealthCare.
- To not upload, download, transmit or otherwise distribute any Content that would constitute or encourage a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
- To not attempt to obtain unauthorized access to WikiHealthCare or portions of WikiHealthCare which are restricted from general access or outside your permitted areas of access;
- To not interfere with or disrupt networks, systems, and/or computers connected to WikiHealthCare, and you will comply with all regulations, policies, and procedures of such networks and systems; and
- To comply with all United States laws regarding the transmission of technical data exported from the United States.
6. Attribution and No Endorsement. If you distribute to third parties information derived in whole or in part from the site, you will at the same time inform such third parties that The Joint Commission's WikiHealthCare site is the source of such information, but The Joint Commission is not responsible for, nor does it necessarily endorse, any such use of the information.
7. Termination of License. Use of the site contrary to the terms of this agreement automatically terminates this Agreement. Failure to comply with the policies and guidelines that govern the appropriate use of the site will result in the disabling or termination of your user account. The Joint Commission reserves the right to disable or terminate a user's account for any reason.

Disclaimer of Warranties. The Joint Commission has established the WikiHealthCare site as an online collaborative environment, that is, a voluntary association of individuals and groups working to develop a common resource of healthcare knowledge. The structure of the site allows registered users to alter its content. The content on the site, therefore, has not necessarily been reviewed by people with the expertise required to provide you with complete, accurate or reliable information. The content of any given article may recently have been changed, vandalized or altered by someone whose opinion does not correspond with the state of knowledge in the relevant fields. As a result,
The Joint Commission cannot guarantee the accuracy or validity of the information found on the site and the content is provided to you *as is. You bear the risk of using it. The Joint Commission gives no express warranties, guarantees or conditions and expressly excludes all implied warranties including merchantability, fitness for a particular purpose and non-infringement.*
9. Limitation and Exclusion of Damages. The Joint Commission's liability under this agreement is limited. You can recover from the Joint Commission and its affiliates only direct damages up to U.S. $5.00. You cannot recover any other damages including consequential, lost profits, special, indirect, incidental or punitive. This limitation applies to:
- Anything arising from or relating to the use of information found on the site;
- Any claim for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence or other tort.
10. Enforcement by The Joint Commission. In the event The Joint Commission determines, in its sole discretion, that you have violated these Terms, The Joint Commission shall have the right to immediately terminate your access to WikiHealthCare, without prior notice to you, and/or pursue any other remedies available to it under applicable law.
11. Governing Law, Applicable Law and Jurisdiction. The law of the State of Illinois governs the interpretation of this agreement and applies to claims for breach of it regardless of conflict of law principles. The litigation of any dispute or claim arising under this agreement shall take place only in the applicable State or federal court sitting in DuPage or Cook County or the Northern District of Illinois USA and you irrevocably consent to jurisdiction of such courts over you and any dispute arising under this agreement.
12. Updates to WikiHealthCare. The Joint Commission reserves the right to modify WikiHealthCare and the materials, features and services provided on WikiHealthCare at any time without prior notice to you.
13. Entire Agreement. This Agreement constitutes the entire agreement with respect to this license. The Joint Commission reserves the right to change these terms from time to time by posting revised terms at:
RegistrationAndUserAgreement. Your continued use of the site following any change will be conclusively deemed acceptance of any change to the terms and conditions. Although we may attempt to notify you via your e-mail address when major changes are made, you should periodically review the agreement page to review the terms.
